Dear Ms. Diamond: In your letter dated April 8, 2008, you requested a tariff classification ruling. As requested, your samples will be returned Enyce Style #0308 is a pair of men’s pants constructed from 100% cotton, blue denim fabric. The pants fall below the knee and have a flat waistband with five belt loops; a zippered, fly front opening with a metal button closure on the waistband; two pockets on the front panel; an inner pocket within the right front pocket; two rear patch pockets with studs, screen printing and embroidery; a woven fabric patch with an embroidered logo on the rear waistband; and hemmed legs. Enyce Style #0408 is a pair of men’s pants constructed from 100% cotton, embroidered twill fabric. The pants fall below the knee and have a flat waistband with five belt loops; a zippered, fly front opening with a button closure on the waistband; two pockets on the front panel; an inner pocket within the right front pocket; two rear patch pockets; woven labels on the rear waistband and the rear pocket; and hemmed legs. The applicable subheading for Enyce Style #0308 is 6203.42.4011, Harmonized Tariff Schedule of the United States (HTSUS), which provides for men’s or boys' … trousers, bib and brace overalls, breeches and shorts (other than swimwear): of cotton: other: other: trousers and breeches: men’s: blue denim. The duty rate is 16.6% ad valorem. The applicable subheading for Enyce Style #0408 will be 6203.42.4016, Harmonized Tariff Schedule of the United States (HTSUS), which provides for men’s or boys’ … trousers, bib and brace overalls, breeches and shorts (other than swimwear): of cotton: other: other: trousers and breeches: men’s: other. The duty rate is 16.6% ad valorem. Enyce Style #0308 and Style #0408 fall within textile category designation 347. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries.
