N024446 March 28, 2008 CLA-2-38:OT:RR:NC:2:239 CATEGORY: Classification TARIFF NO.: 3824.90.9290 Ms. Eleanore Kelly-Kobayashi Rode & Qualey 55 West 39th Street New York, NY 10018 RE: The tariff classification of a chemical mixture, imported in bulk form, from Japan Dear Ms. Kobayashi: In your letter dated March 11, 2008, you requested a tariff classification ruling for a chemical mixture on behalf of your client Becton Dickinson Infusion Therapy Systems Inc. The product, composed of 33.3% Sodium fluoride, an antiglycolytic agent, and 66.7% Disodium ethylenediaminetetraacetate dihydrate, an anticoagulant, is a granulated additive particle formulation used in blood collection tubes for transportation and storage of blood specimens prior to routine clinical analysis. The product is a chemical mixture composed of an organic and inorganic compound. In your letter you suggest classification under 2922.49.8000, HTSUS which provides for Oxygen-function amino compounds: Amino-acids, other than those containing more than one kind of oxygen function, and their esters; salts thereof: Other: Other: Other: Other. As a general rule, this Chapter is restricted to separate chemically defined compounds, subject to the provisions of Note 1 to the Chapter. Separate chemically defined compounds containing other substances deliberately added during or after their manufacture (including purification) are excluded from this Chapter. The mixture, however, is properly classified in 3824.90.9290, Harmonized Tariff Schedule of the United States (HTSUS), which provides for prepared binders for foundry molds or cores; chemical products and preparations of the chemical or allied industries (including those consisting of mixtures of natural products), not elsewhere specified or included: other. The rate of duty will be 5 percent ad valorem. Duty rates are provided for your convenience and are subject to change. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
