Two Claiborne Avenue Bldg HQ2 7th Floor North Bergen, NJ 07047 RE: The tariff classification of woman’s jacket from Sri Lanka Dear Ms. Diamond: In your letter dated February 12, 2008, you requested a classification ruling. Your sample will be returned as requested. Submitted sample, style #LCMUW895, is a woman’s jacket constructed from 100% cotton woven fabric. The jacket extends from the shoulder to slightly below the hips. The collarless jacket features long sleeves with buttoned cuffs, a full front opening secured by six buttons, a drawstring tie at the waist, two pockets below the waist, decorative embroidery on the upper rear panels and left sleeve and a hemmed bottom. The garment is a jacket, a hybrid garment, which lacks sufficient characteristics to be considered a shirt. The applicable subheading for the style LCMUW895 will be 6211.42.0075, Harmonized Tariff Schedule of the United States (HTSUS), which provides for track suits, ski-suits and swimwear; other garments: other garments, women’s or girls’: of cotton: jackets and jacket-type garments excluded from heading 6202. The duty rate will be 8.1 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
