N022360 February 6, 2008 CLA-2-62:OT:RR:NC:TA:360 CATEGORY: Classification TARIFF NO.: 6211.42.0075 Ms. Maristella Iacobello Phillips Van Heusen Corporation 200 Madison Avenue New York, NY 10018 RE: The tariff classification of women’s jackets from Bangladesh Dear Ms. Iacobello: In your letter dated January 22, 2008, you requested a classification ruling. Your samples will be returned as requested. Submitted sample, style #4833023, is a woman’s jacket constructed from 100% cotton woven fabric. The jacket features a collar, ¾ length sleeves, a full front opening secured by three buttons, two pockets below the waist, a back centered pleat and a hemmed bottom. Submitted sample, style #4853015, is a woman’s jacket constructed from 100% cotton woven fabric. The jacket features a collar and lapels, ¾ length sleeves, a full front opening secured by two buttons, one chest pocket with a buttoned flap, two pockets with flaps below the waist, a back centered pleat and a hemmed bottom. The garment also has a buttoned tab on the upper right front panel. The applicable subheading for the styles 4833023 and 4853015 will be 6211.42.0075, Harmonized Tariff Schedule of the United States (HTSUS), which provides for track suits, ski-suits and swimwear; other garments: other garments, women’s or girls’: of cotton: jackets and jacket-type garments excluded from heading 6202. The duty rate will be 8.1 percent ad valorem. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. Both styles fall within textile category 335. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries.
