Dear Mr. Ryu: In your letter dated January 9, 2008, you requested a tariff classification ruling. The submitted sample, style 8364-1502 is a girl’s sweatshirt type jacket. The item is constructed of finely knit cotton fabric that is napped on the inside. The jacket has a hood, a full front opening with zipper closure, long sleeves with rib-knit cuffs, patch pockets with scoop openings that are finished with rib–knit fabric and a rib-knit bottom. The applicable subheading for style 8364-1502 will be 6102.20.0020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ overcoats, carcoats, capes, cloaks, anoraks, wind-breakers, and similar articles, knitted or crocheted, other than those of heading 6104, of cotton, girls’. The rate of duty will be 15.9 percent ad valorem. Duty rates are provided for your convenience and are subject to change. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
