Menendez, Jr. Sack & Menendez, Inc. 1604 Fourth Avenue Tampa, Florida 33605 RE: The tariff classification of three decorative glass articles from China Dear Mr. Menendez: In your letter dated October 22, 2007, on behalf of your client, Beachcombers International, Inc., you requested a tariff classification ruling. Three representative samples were submitted with your ruling request. Item number 89-2064-05 is described as a hand-blown, completely closed, glass orb measuring six inches in diameter. Item number 89-2066-02, is described as a hand-blown, completely closed, glass orb measuring three inches in diameter. Each glass orb is encircled in knotted jute netting with a looped end for hanging purposes. Item number 89-2067-3, consists of three hand-blown, completely closed, glass orbs encircled in knotted jute netting. Each glass orb is individually separated by cork disks. The measurements of each orb are three inches, four inches and five inches in diameter and are arranged in graduating size order with a looped end attached to the three inch orb. In your letter you stated that although the glass orbs are colored prior to solidification, they do not contain bubbles, seeds or stones. You indicated in your letter that the unit value of each glass article (item numbers 89-2064-05, 89-2066-02, and 89-2067-3) is over thirty cents but not over three dollars. The applicable subheading for the decorative glass orbs (item numbers 89-2064-05, 89-2066-02, and 89-2067-3) will be 7013.99.5000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for glassware of a kind used for table, kitchen, toilet, office, indoor decoration or similar purposes… other glassware: other: other: other: valued over thirty cents not over three dollars each. The rate of duty will be 30 percent ad valorem.    Duty rates are provided for your convenience and are subject to change. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
