Dear Ms. Dawson: In your letter dated August 1, 2007 you requested a tariff classification ruling. Item number 1G00SWP is referred to as the Sweet Peace Newborn Infant Soothing Center. The Soothing Center is designed to sit on the floor and consists of a plastic swing and swaddle blanket. The swing is actually a seat that can be fitted into a base equipped with electronic equipment that mimics the swaying motion of a parent holding the child. The electronic sound equipment generates womb sounds, nature sounds and soothing music. The seat is removable and becomes a rocker. Item number PE-30462, the swaddle blanket, is of cotton flannel fabric. The blanket has an opening through which a belt can be run and Velcro straps to wrap the blanket closely around the child. The blanket will be imported separately but will be packaged with the swing as an accessory. The sample will be returned to you, as requested. The applicable subheading for the infant seat will be 9401.80.4045, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Seats (other than those of heading 9402) whether or not convertible into beds, and parts thereof: Other seats: Of rubber or plastics: Other: Other.” The rate of duty will be free. The applicable subheading for the swaddle blanket will be 6307.90.9889., Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Other made up articles, incl. dress patterns: Other: other, other.” The rate of duty will be 7% ad valorem. Duty rates are provided for your convenience and are subject to change. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
