Dear Mr. Mantering: In your letter dated July 12, 2007, you requested a tariff classification ruling. Your submitted sample, style SR0108-3357B is a pair of boy’s shorts constructed of 100% polyester woven fabric. The shorts feature an elasticized waist, side mesh inserts, two front slash pockets, a small embroidered Starter™ logo on the bottom of the right leg and hemmed fabric with side slits at the leg openings. The applicable subheading for style SR0108-3357B will be 6203.43.4040, Harmonized Tariff Schedule of the United States (HTSUS), which provides for men’s or boys’ suits, ensembles, suit-type jackets, blazers, trousers, bib and brace overalls, breeches and shorts: trousers, bib and brace overalls, breeches and shorts: of synthetic fibers: other: other, other: other, shorts: boys’. The duty rate will be 27.9 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
