Broad Street Philadelphia, PA 19112-1404 RE: The tariff classification of a woman’s shirt and pullover from China Dear Mr. Hoffacker: In your letter dated May 18, 2007, you requested a classification ruling on behalf of Thoughts Embellished Inc. Your samples will be returned as requested. Submitted sample, style #A15437, consists of a woman’s shirt and pullover. The shirt is constructed from 100% cotton woven corduroy fabric. The shirt features a collar, long sleeves with buttoned cuffs, a full front opening secured by six buttons, four inch side vents, and hemmed bottom. The shirt is embellished with embroidered designs. The woman’s short sleeved pullover is constructed from 100% cotton knit fabric. The pullover features a round front neckline, a hemmed bottom and a sequined pumpkin design at the center of the bust area. The applicable subheading for the shirt will be 6206.30.3041, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ blouses, shirts and shirt-blouses: of cotton: other: other: other: other: women’s. The duty rate will be 15.4 percent ad valorem. The applicable subheading for the pullover will be 6110.20.2079, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other: other: other: women’s or girls’ other. The duty rate will be 16.5 percent ad valorem. Duty rates are provided for your convenience and are subject to change. The shirt falls within textile category 341 and the pullover falls within category 339. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
