N009021 April 11, 2007 CLA-2-95:RR:NC:2:224 CATEGORY: Classification TARIFF NO.: 9503.00.0080 Mr. Pete Mento Expeditors Tradewin, LLC 1015 3rd Avenue, 12th Floor Seattle, WA 98104 RE: The tariff classification of a Pleo™ toy from China Dear Mr. Mento: In your letter dated March 26, 2007, you requested a tariff classification ruling, on behalf of Ugobe, Inc., your client. You are requesting the tariff classification on an item that is identified as a Pleo™ toy product. The Pleo™ is a robotic toy dinosaur that is extremely high-tech. It is a sophisticated toy that is designed for children over eight years of age and for adults. It is capable of the following activities: making natural sounds, performing tricks, conveying emotions, and Pleo™ to Pleo™ communication. The toy behaves and interacts in a lifelike and natural manner. It will be considered a toy, classifiable in Chapter 95, for the purposes of the tariff. The applicable subheading for the Pleo™ toy will be 9503.00.0080, Harmonized Tariff Schedule of the United States (HTSUS), which provides for tricycles, scooters…and similar wheeled toys; dolls’ carriages; dolls, other toys; reduced-scale (“scale”) models…parts and accessories thereof…other. The rate of duty will be free. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
