Cohen American Signature Inc. 1800 Moler Road Columbus, OH 43207 RE: The tariff classification of a utility cart from China Dear Mr. Cohen: In your letter dated December 22, 2006, you requested a tariff classification ruling. The merchandise is a wheeled cart made primarily of base metal. It has a deck measuring 48 inches wide by 96 inches long by 13 inches high, four 8-inch castors, a U-shaped push handle, and a hook for pulling. Your letter states that the cart is used within a warehouse to move merchandise by hand or by a forklift between a dock door and the warehouse racks. The applicable subheading for the cart will be 8716.80.5090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for trailers and semi-trailers; other vehicles, not mechanically propelled; and parts thereof, other vehicles, other, other, other. The rate of duty will be 3.2 percent ad valorem. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
