Worldwide Customs Compliance 333 Continental Blvd. El Segundo, CA 90245-5012 RE: The tariff classification of backpack from China Dear Ms. Shafran: In your letter dated November 20, 2006, you requested a tariff classification ruling. The submitted sample is identified as the “Nature Babies Cuddle ‘N Care Backpack,” toy number K9701. It is a child’s backpack constructed with an outer surface of man-made textile material. It measures approximately 9” (W) x 11” (H) x 3” (D). It features two shoulder straps, one main storage compartment with a three-sized zippered closure, and two interior pockets. The applicable subheading for the backpack will be 4202.92.3020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for travel, sport, and similar bags, with outer surface of textile materials, of man-made fibers, backpacks. The rate of duty will be 17.6% ad valorem. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. Tariff number 4202.92.3020 falls within textile category 670. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise, which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries.
