Kuflik Panasonic Corporation of North America One Panasonic Way 3B-6 Secaucus, NJ 07094 RE: The tariff classification of an incomplete televisions. Dear Ms. Kuflik: In your letter dated October 20, 2006 you requested a tariff classification ruling. The items in question are various incomplete televisions denoted as “TV Units”. The units are used in the manufacture, after importation, of varying sizes of rear projection televisions. The units are denoted as model numbers: - LSXA0846-HB OPT/TV Unit 50 720 SKD - LSXA0889-HB OPT/TV Unit 56 720 SKD - LSXA0870-HB OPT/TV Unit 61 720 SKD - LSXA0871-HB OPT/TV Unit 50/56 1080 SKD - LSXA0872-HB OPT/TV Unit 61 1080 SKD The numbers 50,56, and 61 represent the eventual screen diagonal measurement of the completed rear projection television. Each unit contains the assemblies denoted in Additional US Note 10 to chapter 85 and a power supply. They do not contain the screen that will be added along with PCBs for operations and the HDMI jack, an SD card slot speaker and various molded parts. Also the units do not contain a cabinet nor any video recording or reproducing apparatus. The applicable subheading for the TV Units will be 8528.12.08, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Reception apparatus for television, whether or not incorporating radiobroadcast receivers or sound or video recording or reproducing apparatus; video monitors and video projectors: Reception apparatus for television whether or not incorporating radiobroadcast receivers or sound or video recording or reproducing apparatus: Color: Incomplete or unfinished (including assemblies for television receivers consisting of all the parts specified in additional US note 10 to this chapter plus a power supply), not incorporating a cathode-ray tube, flat panel screen or similar display device: Other. The rate of duty will be free. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). Pursuant to title 19 United States Code, Section 3005 The Harmonized Tariff Schedule of the United States is expected to be amended effective 1/1/07. The amendments are expected to affect the classification of your merchandise. Pursuant to Section 3005 c, the report recommending those changes has been sent to the President for proclamation of the changes. Upon the expiration of sixty legislative days, in the absence of Congressional action, the recommended changes will become law. Accordingly based on that recommendation, it is anticipated that your merchandise will be classified in 8528.72.08 under the 2007 Harmonized Tariff Schedule. Under the circumstances, this classification under the 2007 tariff is advisory only. A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
