NY M86079 September 5, 2006 CLA-2-42:RR:NC:3:341 M86079 CATEGORY: Classification TARIFF NO.: 4202.92.9026 Ms. Erin Barclay Case Logic, Inc. 6303 Dry Creek Parkway Longmont, CO 80503 RE: The tariff classification of a calculator case from China Dear Ms. Barclay: In your letter received in the office on August 14, 2006, you requested a classification ruling. The sample will be returned as requested. You have submitted a sample of a calculator case, which you refer to as “Case Logic’s Model CCS-1.” It is constructed with an outer surface of nylon textile fabric and is used for the storage, protection, organization and portability of a calculator and related accessories during travel. It measures approximately 8” (W) x 5” (H) x 1.5” (D). It features a carrying handle, a zipper closure on three sides, one interior pouch pocket, one pen loop, and two elastic straps used to keep the calculator in place. The applicable subheading for the calculator case will be 4202.92.9026, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Other containers and cases, other, with outer surface of textile materials, of man-made fibers. The duty rate will be 17.6 percent ad valorem. 4204.92.9026 falls within textile category designation 670. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
