Schaeffer Grunfeld, Desiderio, Lebowitz, Silverman & Klestadt LLP 399 Park Avenue, 25th floor New York, NY 10022-4877 RE: The tariff classification of a woman’s pullover from China Dear Ms/ Schaeffer: In your letter dated August 3, 2006, you requested a classification ruling on behalf of Bernard Chaus, Inc. A sample identified as style 5166200 was submitted and will be retained by this office for official purposes. The garment is made of both woven and knit fabric components. It is a pullover with a woven banded collar and front placket, and woven long sleeve with cuffs, all of the foregoing made of 100% cotton woven fabric. These sleeves and collar components are joined to a finely knit v necked pullover, which is made of 55% silk, 23% viscose, and 22% nylon knit fabric. The essential character of the garment is imparted by its portion. The applicable subheading for style 5166200 will be 6110.90.9090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, pullovers…and similar articles, knitted or crocheted: Of other textile materials: Other: Other: Other: Women’s or girls’. The duty rate will be 6% ad valorem. Duty rates are provided for your convenience and are subject to change.
