NY M83955 June 5, 2006 CLA-2-42:RR:NC:N3:341 M83955 CATEGORY: Classification TARIFF NO.: 4202.12.8070 Orlando Rodriguez P.R. Retail Stores, Inc. D/B/A Almacenes Pitusa P.O. Box 839 Hato Rey Station San Juan, PR 00919-0839 RE: The tariff classification of vertical pullman suitcases from China Dear Mr. Rodriguez: In your letter dated May 1, 2006, you requested a tariff classification ruling. The items in question are vertical pullman suitcases. The two piece sets are identified as “Trolley Cases” (Item #AH02530). They are covered with black polyester 600D textile fabric and measure 18” and 21”. We assume both sizes are the same suitcase except for size. The four piece “Trolley Cases” sets (Item #AH02530) are also covered with black polyester 600D textile fabric. The four sizes measure 17”, 21”, 25”, and 29”. Again, we assume the only difference is size. The applicable subheading for the vertical Pullman suitcases will be 4202.12.8070, Harmonized Tariff Schedule of the United States (HTSUS), which provides for trunks, suitcases, vanity cases, and similar containers, with outer surface of textile materials, other, other, other, of man-made fibers. The rate of duty will be 17.6% ad valorem. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
