Dear Ms. Kay: In your letter dated May 19, 2006 you requested a classification ruling. The instant sample, style P799WP, is a pillow. The outer shell is made from multiple fabrics that include twill, coated and woven pile. The fabrics are stated to be made from 100 percent cotton. It is stuffed with a polyester filler. The size of the pillow will be approximately 16 x 6.5 x 5.5 inches. The pillow is stylized to resemble a skateboard. The applicable subheading for the pillow will be 9404.90.1000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for mattress supports; articles of bedding and similar furnishing (for example, mattresses, quilts, eiderdowns, cushions, pouffes and pillows) fitted with springs or stuffed or internally fitted with any material or of cellular rubber or plastics, whether or not covered: other: pillows, cushions and similar furnishings: of cotton. The rate of duty will be 5.3 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
