NY M83211 June 14, 2006 CLA-2-61:RR:NC:TA:N3:356 M83211 CATEGORY: Classification TARIFF NO.: 6112.12.0010; 6112.12.0050 Mr. Kevin Maher C-Air Customhouse Brokers 181 South Franklin Avenue Valley Stream, New York 11581 RE: The tariff classification of a men’s knit track suit from Vietnam Dear Mr. Maher: In your letter dated May 12, 2006, on behalf of Anaconda Sports, you requested a tariff classification ruling. Your samples are being returned, as you requested. The sample submitted, style “Campi”, is a men’s tracksuit consisting of a jacket and a pair of pants. Both garments are constructed from 100% polyester interlock knit fabric. The jacket features a mock turtleneck collar, a full front opening secured by a zipper closure that extends to the top of the collar, long sleeves with rib knit cuffs, two zippered slant pockets below the waist, a mesh fabric insert under the arms and on the outer sides of the front and rear panels, and a rib knit waistband. The pants feature a tunnel elastic waistband with an inner drawstring tightening, two side seam pockets below the waist, and long hemmed legs with a zipper opening at the ankles. The applicable subheading for the jacket will be 6112.12.0010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for: track suits, ski suits and swimwear, knitted or crocheted: tracksuits of synthetic fibers: garments described in heading 6101 or 6102: men’s or boys’. The rate of duty will be 28.2% ad valorem. The applicable subheading for the pants will be 6112.12.0050, Harmonized Tariff Schedule of the United States, (HTSUS), which provides for: track suits, ski suits and swimwear, knitted or crocheted: tracksuits of synthetic fibers: trousers: men’s or boys’. The rate of duty will be 28.2% ad valorem. Duty rates are provided for your convenience and are subject to change.
