Dear Ms. Edelman: In your letter dated December 5, 2005, you requested a classification ruling for a wine bottle bag. The sample submitted is identified as “Sari Wine Bag”. No style number was submitted. The item is a fitted wine bottle bag manufactured with an exterior surface of man-made fiber textile materials. The bag is in the general shape and dimensions of a bottle and is designed to contain one bottle. It is secured by means of a braided drawstring top closure. It measures approximately 15”(H) x 6”(W). Your sample is being returned as requested. The applicable subheading for the wine bottle bag will be 4202.92.9026, Harmonized Tariff Schedule of the United States (HTS), which provides in part, for other bags and containers, with outer surface of textile materials, other, other, of man-made fibers. The duty rate will be 17.6 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
