Dear Mr. Conlon: In your letter of November 16, 2005 you requested a tariff classification ruling. Your samples are being returned. Item # 62306374 Halloween Figure Candles with Metal Coffins consist of 3-dimensional figure shaped wax candles set in beds of wax poured in coffin shaped tins (approx. 5”L x 2.75”W x 1.5”H) in four styles: witch, mummy, monster and skeleton. The candles are said to contain 100% paraffin wax. The applicable subheading for the 3-dimensional figure shaped wax candles set in beds of wax poured in tins will be 3406.00.0000, Harmonized Tariff Schedule of the United States, which provides for candles, tapers and the like. The rate of duty is free. Candles from China may be subject to anti-dumping duties administered by the U.S. Department of Commerce, Import Administration.
