Dear Ms. Mugrage: In your letter dated November 29, 2005, you requested a classification ruling for a woman’s knit garment from Hong Kong. The submitted sample will be returned to you, as requested. Style 3R0841 is a woman’s upper body garment constructed from 40 percent viscose, 32 percent nylon, 21 percent cotton and seven percent angora knit fabric. The garment does not reach the waist and has a full front opening and short sleeves. The body of the garment is constructed from a pointelle knit fabric, and the neckline, front opening and bottom are finished with a rib knit panel. The panel that finishes the bottom of the garment extends twelve inches on both sides to form ties. The front of the garment does not provide coverage of the bust area. The applicable subheading for style 3R0841 will be 6114.30.3070, Harmonized Tariff Schedule of the United States (HTS), which provides for Other garments, knitted or crocheted: Of man-made fibers: Other: Women’s or girls’. The duty rate will be 14.9% ad valorem. Duty rates are provided for your convenience and are subject to change.
