Dear Ms. Da Rocha: In your letter, received on November 2, 2005, you provided the follow-up information required for a tariff classification ruling for your client, Products of Tomorrow, Towaco, NJ. The Todd English CollectionTM brand knife set is a three piece knife set comprised of an 8” chef knife, 4 ½” paring knife, and 8 ½” knife sharpener. The cutlery has steel blades and bakelite handles. In your correspondence you state that the knife sharpener is made of steatite ceramics. You also state that this merchandise will be sold to and used by individual consumers. These kitchen articles will be used in the home. The knife set is packed in a fitted wood fiberboard box. The applicable subheading for the knife set will be 8211.10.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for knives with cutting blades, serrated or not (including pruning knives), other than knives of heading 8208, and blades and other base metal parts thereof: sets of assorted articles. The set will be dutiable at the rate of duty applicable to that article in the set subject to the highest rate of duty. Since the rate of the knife sharpener (9.8 percent) is the highest, it will apply to the whole set. The complete tariff classification for this set will be 8211.10.0000/6912.00.4810, HTS.
