D5-254B Hoffman Estates, IL 60179 RE: The tariff classification of a men’s woven garment from Bangladesh. Dear Mr. Walton: In your letter dated September 15, 2005, you requested a tariff classification ruling. As requested, your sample will be returned. Style MS6CV2089 is a men’s garment constructed from 100 percent polyester, woven fabric. The garment extends from the waist to below the knee and has a non-elastic front waistband with a tunnel elastic rear waistband; a fly front opening with hook and loop closures; a drawstring sewn to the front waistband that is laced through two waistband tabs; a full mesh liner; two front inset pockets; a cargo pocket on each leg with a flap, a hook and loop closure, and grommets; a rear patch pocket with a flap, a hook and loop closure, and grommets; an inner mesh key pocket; and hemmed leg openings. The applicable subheading for Style MS6CV2089 will be 6203.43.4010, Harmonized Tariff Schedule of the United States (HTS), which provides for men’s and boys’ . . . trousers, . . . and shorts (other than swimwear): of synthetic fibers: other: other: other: other: trousers: men’s. The rate of duty is 27.9 percent ad valorem. Style MS6CV2089 falls within textile category designation 647.
