Dear Mr. Lambert: In your letter dated September 19, 2005, on behalf of Limited Stores, you requested a classification ruling. As requested, the samples will be returned to you. Your submitted sample, style SCO618JU5 is a crocheted scarf that will be imported in two color-ways, gold and black. The gold scarf is composed of 95% rayon and 5% metallic. The black scarf is composed of 100% rayon with plastic beads sewn on near the ends. The scarves measure approximately 72 inches long and four inches wide and are worn around the neck. The applicable subheading for style SCO618JU5 black and gold will be 6117.10.2030, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up clothing accessories, knitted or crocheted; knitted or crocheted parts of clothing accessories: shawls, scarves, mufflers, mantillas, veils and the like: of man-made fibers, other. The duty rate will be 11.3 percent ad valorem. Style SCO618JU5 falls within textile category designation 659.
