New York, N.Y. 10016 RE: The tariff classification of a man’s jacket from China Dear Ms. Epstein: In your letter dated August 26, 2005, on behalf of your client, Kindnoon Offshore Trading Co. Ltd., you requested a classification ruling. The sample submitted, style number PGFA06-01 “Hooded Twill Upland Shirt”, is a man’s upper-thigh length jacket constructed of a shell composed of a woven 100% cotton twill fabric. The jacket is lined with a woven 100% polyester taffeta fabric that is quilted in a diamond pattern to a nonwoven polyester batting fill. The jacket has an integral hood with a drawcord tightening, a fold-down pointed collar, a full front opening secured by a zipper closure and a chest warmer insert. An overlapping flap with six left-over-right button closures covers the front zipper area. The jacket’s chest warmer insert and the lining fabric in the hood are composed of a heavy brushed knit 65% polyester /35% cotton fleece fabric. The jacket has front and rear yokes composed of a contrasting color fabric that is quilted in a diamond pattern to a nonwoven batting fill, a pocket with a flap secured by a button closure on the left chest, two side seam pockets at the waist, long vented sleeves with a button closure on the vent opening and a button closure on the cuffs, and a straight cut hemmed bottom with two side seam vents. The sample is being returned to you as you have requested. The applicable subheading for the jacket will be 6201.92.2051, Harmonized Tariff Schedule of the United States (HTS), which provides for other: men’s anoraks, windbreakers and similar articles: of cotton. The duty rate will be 9.4 percent ad valorem. The jacket falls within textile category designation 334. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
