Box 58710 Seattle, WA 98138 RE: The tariff classification of a men’s knit vest from China. Dear Ms. Clemente: In your letter dated August 16, 2005, you requested a tariff classification ruling. As requested, your sample will be returned. Style R405428 is a men’s vest constructed from 55 percent acrylic, 45 percent cotton, jersey knit fabric that measures 12 stitches per two centimeters counted in the horizontal direction. Style R405428 features a V-neckline, oversized armholes with full fashion marks, tubular capping at the neckline and armholes, and a tubular knit bottom. The applicable subheading for Style R405428 will be 6110.30.3030, Harmonized Tariff Schedule of the United States, (HTS), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of man-made fibers: other: other: other: other: vests, other than sweater vests: men’s or boys’. The rate of duty is 32 per cent ad valorem. Style R405428 falls within textile category designation 659.
