Dear Mr. Stack: In your letter dated May 25, 2005, you requested a classification ruling on behalf of Item Eyes, Inc. A sample of style 61155T was submitted and will be returned as you have requested. This garment is an unlined woman’s short sleeved bolero-styled jacket, comprised of three panels sewn together lengthwise to form the body of this jacket. The jacket scantily covers the bosom of the garment and is not intended to be worn closed; there is neither button nor other appropriate device to close the front panels of the garment. The fabric of the garment is openwork knit mesh made of 55% ramie and 45% cotton fibers. The applicable subheading for style 61155T will be 6104.39.2090, Harmonized Tariff Schedule of the United States (HTS), which provides for Women’s or girls’ suits…suit-type jackets…knitted or crocheted: Suit-type jackets and blazers: Of other textile materials: Other: Other: Other. The duty rate will be Free. Style 61155T falls within textile category designation 835.
