Fritz Mezger, Inc. of Spartanburg, S.C. you requested a tariff classification ruling. Literature has been provided for temples of various types. You state that the temple is an integral part of a weaving machine and that weaving machines always have a pair of temples. The temples are used to keep the newly woven material at the correct width. A temple is essentially made of a steel shaft upon which burrs, plastic rings with needle pins embedded in the surface, are mounted. (A sample of a burr has been provided.) The length of a temple typically ranges from 4 to 6 inches and the diameter is approximately a ½ inch. The applicable subheading for the weaving machine temples will be 8448.49.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for parts and accessories for use solely with the machines of this heading or of heading 8444, 8445, 8446 or 8447: parts and accessories of weaving machines (looms) or of their auxiliary machinery: other. The rate of duty will be free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
