Dear Mr. Sklar: In your undated letter, received in this office on December 6, 2004, you requested a tariff classification ruling. Eight sample bags were provided with your letter. All the bags are said to be composed of a mixture of 60 percent by weight of polypropylene and 40 percent by weight of polyethylene. The bags come in various shapes and sizes with various kinds of handles. Four of the bags are printed with the names of stores and/or products. These bags are the kind generally used to convey merchandise from a store. Three other bags are printed with designs only. These latter bags are frequently known as gift bags. The applicable subheading for the bags will be 3923.29.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for articles for the conveyance or packing of goods, of plastics…sacks and bags…of other plastics.. The rate of duty will be 3 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
