Box 9021253 San Juan, P.R. 00902-1253 RE: The tariff classification of a Pullman Suitcase from China. Dear Ms. D Rosa: In your letter dated September 29, 2004, on behalf of Sombrillas La Isla, Inc., you requested a classification ruling for a Pullman Suitcase. The sample submitted is not identified by style number. The item is a Pullman Suitcase with telescopic handle and wheels designed to contain clothing and other personal effects during travel. It is manufactured with an exterior and interior surface of man-made fiber textile materials. The case features a front exterior full-width zippered pocket for additional storage. It measures approximately 21”(W) x 14”(H) x 7”(D). The applicable subheading for the suitcase will be 4202.12.8070, Harmonized Tariff Schedule of the United States (HTS), which provides for trunks, suitcases, vanity cases and similar containers, with outer surface of textile materials, other, other, of man-made fibers. The duty rate will be 17.6 percent ad valorem. HTS 4202.12.8070 falls within textile category designation 670. Based upon international textile trade agreements products of China are not currently subject to quota and the requirement of a visa. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
