Suite 308 Toronto, Ontario M8V 1A4 RE: The tariff classification of a man’s jacket from India Dear Ms. Fust: In your letter dated November 5, 2004, you requested a classification ruling. The sample submitted, style number J-783, is a man’s hip-length baseball-style jacket. In a phone conversation you indicated that the jacket has a body shell composed of a woven 75% wool/10% nylon/10% polyester/ 5% other fibers fabric with leather sleeves and leather trim on the pockets. The jacket is lined with a woven 100% nylon fabric that is quilted in a diamond pattern to a nonwoven batting fill. The jacket has a full front opening secured by a left-over-right, seven snap closure, a neck warmer collar composed of a ribbed-knit fabric, long sleeves with ribbed-knit fabric cuffs and a ribbed-knit fabric waistband. The jacket has two front slash pockets at the waist and an inner pocket. In your letter you suggested classification of the jacket under HTS 4203.10.4030. The essential character of this jacket is imparted by the woven body portion, which is in chief weight of wool. The applicable subheading for the jacket will be 6201.91.2011, Harmonized Tariff Schedule of the United States (HTS), which provides for other men’s anoraks (including ski-jackets), windbreakers and similar articles: of wool or fine animal hair. The duty rate will be 49.7¢/kg + 19.7 percent ad valorem. The jacket falls within textile category designation 434. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
