Mentor, OH 44060 RE: The tariff classification of medical accessories from Germany. Dear Mr. Malin: In your letter dated September 20, 2004, you requested a ruling on tariff classification. The merchandise consists of shelves, swivel cabinets, shelves with drawer modules, drawer modules and keyboard trays. The items are made of steel and plastic. They are designed to be mounted onto Surgical Light and EMS units. In your letter, you suggest that the items be classified in chapter 94, HTS, as furniture. The items are not within the headings for furniture, since they are accessories for a Surgical Light or EMS (Orbiter) Unit. The keyboard tray is not intended to be used with ADP machines. The applicable subheading for this product will be 7326.90.8587, Harmonized Tariff Schedule of the United States (HTS), which provides for other articles of iron or steel, other. The general rate of duty will be 2.9 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R.). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
