Dear Ms. Tovar: In your letter dated September 5, 2004, on behalf of Finishes First, Inc., you requested a tariff classification ruling. The furniture items to be imported are as follows: Item 46-510 is a wooden chest measuring 35.5”W x 36”H x 20”D. It has a top drawer and two front doors that open with an adjustable shelf inside. The item is used in hallways or dining area. Item 41-400 is wooden end table. It is used at the end of a sofa or next to a chair. Item 43-400 is a wooden occasional table that is made to fit against the wall. Item 05-510 is a wooden entertainment armoire. It is fitted with adjustable shelves to accommodate a television, VCR, DVD, and/or stereo equipment. This item would be used in a living room or family room. The applicable subheading for the all of the above described wooden furniture items will be 9403.60.8080, Harmonized Tariff Schedule of the United States (HTS), which provides for “Other furniture and parts thereof: Other wooden furniture: Other, Other.” The rate of duty will be free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
