Dear Mr. Ng: In your letter dated June 30, 2004, you requested a classification ruling on behalf of Ladymate, Inc. The provided samples will be returned as per your request. Style LDM1059 is a women’s sports brassiere made of a seamless constructed 80% nylon 10% cotton 10% spandex knitted fabric. A distinct heavy ribbed knit construction outlines the lower bust area extending to the doubled fabric 1-inch hemmed bottom band. The brassiere features a scoop neckline and a racer back. Style OB001Y is a women’s sports brassiere constructed of a 80% cotton 20% spandex knitted fabric. The brassiere features a heat set fabric bust area with inside pockets for the placement of removable foam cups. Additional features include a collar with a zippered front opening, a heavily elasticized 1-inch bottom band, and a v-shaped panel at the rear neckline with adjustable diagonal shoulder straps. The applicable subheading for Style LDM1059 will be 6212.10.9020, HTS, which provides for Brassieres, girdles, corsets, braces, suspenders, garters and similar articles and parts thereof, whether or not knitted or crocheted: brassiere: other: other . . . of man-made fibers. The general rate of duty will be 16.9 percent ad valorem. The applicable subheading for Style OB001Y will be 6212.10.9010, HTS, which provides Brassieres, girdles, corsets, braces, suspenders, garters and similar articles and parts thereof, whether or not knitted or crocheted: Brassiere: Other: Other . . . Of cotton. The general rate of duty will be 16.9 percent ad valorem. Style LDM1059 falls within textile category designation 649 and Style OB001Y falls within textile category designation 349. Based upon international textile trade agreements products of China are subject to quota. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the Textile Status Report for Absolute Quotas, which is available at our Web site at www.cbp.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
