Dear Ms. Paek: In your letter dated, February 25, 2004, on behalf of S and K, you requested a tariff classification ruling. As requested, the samples will be returned to you. Your submitted sample, style S425060 is a knit 65% rayon and 35% nylon capelet. The item is put on over the head, covers the wearer’s shoulders and has fringed edges. Style S425061 is a knit 65% rayon and 35% nylon shawl. The shawl drapes over the shoulders and upper portion of the arms and is triangular in shape. Style S425062 is a knit 65% rayon and 35% nylon upper body garment. The garment features one side sewn closed therefore enclosing the arm and the other side is open from the shoulder to the bottom. The garment has a boat neck and reaches below the waist. The applicable subheading for styles S425060 and S425061 will be 6117.10.2030, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up clothing or accessories, knitted or crocheted; knitted or crocheted parts of garments or clothing accessories: shawls, scarves, mufflers, mantillas, veils and the like: of man-made fibers, other. The rate of duty will be 11.3 percent ad valorem. The applicable subheading for style S425062 will be 6114.30.3070, Harmonized Tariff Schedule of the United States (HTS), which provides for other garments, knitted or crocheted: of man-made fibers: other, other: woman’s or girls’. The rate of duty will be 14.9 percent ad valorem. Style S425062 falls under textile category designation 659. Based upon international textile trade agreements products of Korea are subject to quota and the requirement of a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the Textile Status Report for Absolute Quotas, which is available at our Web site at www.cbp.gov. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
