Dear Ms. Harrison: In your letter dated February 20, 2004, you requested a tariff classification ruling. The provided sample will be returned as per your request. Style ECV-2001 is a women’s sports brassiere constructed of a 92% polyester 8% spandex knitted fabric with an inner front panel constructed of a polyester mesh fabric. The brassiere features a v-neckline at the front and back, elasticized fabric trim at the top of the brassiere which extends to form the shoulder straps, side seams, and a heavy elastic band measuring approximately 1-1/2 inches wide sewn in the bottom hem of the garment. The applicable subheading for Style ECV-2001 will be 6212.10.9020, HTS, which provides for Brassieres, girdles, corsets, braces, suspenders, garters and similar articles and parts thereof, whether or not knitted or crocheted: brassiere: other: other . . . of man-made fibers. The general rate of duty will be 16.9 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
