Dear Mr. Halaburda: In your letter dated January 6, 2004, on behalf of “Alpack”, you requested a classification ruling. You have submitted three samples with your request identified as part numbers 51002, 41003 and 51001-2. The items are two tool pouches designed to be worn on the belt and a tool roll. Each item is specially fitted and designed to contain various hand tools. Each item is manufactured with an exterior surface of polyester man-made fiber textile material. Their size range from approximately 8 ½”(H) x 5 ½”(W) to 16”(W) x 11”(H). The applicable subheading for the tool pouches and tool roll will be 4202.92.9026, Harmonized Tariff Schedule of the United States (HTS), which provides for trunks, suitcases, holsters and similar containers, with outer surface of textile materials, other, other, of man-made fibers. The duty rate will be 17.6 percent ad valorem. HTS 4202.92.9026 falls within textile category designation 670. Based upon international textile trade agreements products of India are not currently subject to quota and the requirement of a visa. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
