NY K81615 December 5, 2003 CLA-2-62:RR:NC:TA:358 K81615 CATEGORY: Classification TARIFF NO.: 6211.42.0056, 6211.42.0081 Patty Kittel Target Customs Brokers Inc. 1000 Nicollet Mall Minneapolis, MN 55403 RE: The tariff classification of two girls’ upper body garments from Bangladesh Dear Ms. Kittel: In your letter dated November 24, 2003 you requested a classification ruling. Submitted style S4G -TOP380 is a sleeveless tank style blouse with button detachable shoulder straps and a flared body. It is constructed of pieced fabric in a patchwork design. Submitted style S4G-TOP378 is a smocked camisole top, straight-cut across the front and back, with thin shoulder straps and without a visible neckline. The garment extends to the waist. Both items are made of cotton poplin fabric and are sized for toddler girls 2-5. As you requested, the sample items are being returned. The applicable subheading for style S4G-TOP380 will be 6211.42.0056, Harmonized Tariff Schedule of the United States (HTS), which provides for other garments…girls’, of cotton, blouses, shirts and shirt-blouses, sleeveless tank styles and similar upper body garments excluded from heading 6206, other. The applicable subheading for style S4G-TOP378 will be 6211.42.0081, Harmonized Tariff Schedule of the United States (HTS), which provides for other garments…girls’, of cotton, other, other. The duty rate for both styles in 2003 is 8.2 per cent ad valorem. The duty rate for both styles in 2004 will be 8.1 per cent ad valorem. Style S4G-TOP380 falls within textile category designation 341. Style S4G-TOP378 falls within textile category designation 359. Based upon international textile trade agreements products of Bangladesh may be subject to quota and the requirement of a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the Textile Status Report for Absolute Quotas, which is available at our Web site at www.cbp.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
