Dear Ms. Roye: In your letter dated September 27, 2003, on behalf of Genlyte Thomas Group, LLC., you requested a tariff classification ruling. The subject merchandise, based on the sample and information provided, is a metal (non-brass) ceiling light fixture, the Pro Series 1, that is referred to as a “can” in the lighting industry. It consists of a cylindrical metal can-shaped recessed lamp housing with an incorporated adjustable socket plate. There is an electrical metal junction box connected to the exterior housing, in addition to specially designed metal bar hangers with pre-positioned nails for securing purposes. It is stated that this light fixture measures approximately 11 ½ inches long by 6 ½ inches wide by 7 ½ inches deep and is designed for a ceiling opening of 6 ½ inches. The applicable subheading for the metal (non-brass) ceiling light fixture will be 9405.10.60, Harmonized Tariff Schedule of the United States (HTS), which provides for lamps and lighting fittings…not elsewhere specified or included…chandeliers and other electric ceiling or wall lighting fittings…of base metal, other than of brass. The rate of duty will be 7.6 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
