Dear Mr. Gat: In your letter dated February 24, 2003, you requested a tariff classification ruling. A sample, ingredients breakdowns, and pictorial literature were submitted with your letter. The sample was examined and disposed of. Item no. OV-205328 Oil and Vinegar Set is comprised of two bottles of infused vinegar and two bottles of infused oil each lying horizontally on a shelf of a steel wire stand. The Thyme Infused Vinegar contains sprigs of thyme floating in vinegar. Similarly the Rosemary Infused Vinegar contains sprigs of rosemary in vinegar. The Chili Infused Oil contains one whole chili pepper and several black peppercorns loosely packed in canola oil with paprika. The Garlic Oil contains granulated garlic in canola oil. The bottles measure approximately 9-1/2 inches tall and the wire stand is approximately 15 inches tall. The applicable subheading for the Chili Infused Oil and the Rosemary Infused Oil in item no. OV-205328 will be 2103.90.8000, HTS, which provides for mixed condiments and mixed seasonings… other…other…other. The rate of duty will be 6.4 percent ad valorem. The applicable subheading for the Thyme Infused Vinegar and The Rosemary Infused Vinegar in item no. OV-205328 will be 2209.00.0000, HTS, which provides for vinegar and substitutes for vinegar obtained from acetic acid. The rate of duty will be 0.5 cents per proof liter. The applicable subheading for the metal rack will be 7323.99.9060, HTS, which provides for table, kitchen or other household articles and parts thereof, of iron or steel…other… other…not coated or plated with precious metal…other…other…other. The rate of duty will be 3.4 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
