Dear Mr. L’Esperance: In your letter dated July 15, 2003, you requested a classification ruling for a Pullman Suitcase. The sample submitted is identified as style #281462201. It is a wheeled suitcase made up of man-made textile materials and ABS plastics. The upper half is of a textile material exterior and the lower half is of ABS plastics. Neither component imparts the essential character to the suitcase. Therefore according to General Rule of Interpretation 3 (c), HTSUSA, the item is classified accordingly to that HTSUSA number that appears last in the tariff. The heading 4202 tariff provision for outer surface of textile materials appears last. The classification will be according to the textile component of the suitcase. Your sample is being returned as requested. The applicable subheading for style #281462201 will be 4202.12.8070, Harmonized Tariff Schedule of the United States (HTS), which provides for trunks, suitcases vanity cases and similar containers, with outer surface of textile materials, other, other, other, of man-made fibers. The duty rate will be 17.8 percent ad valorem. HTS 4202.12.8070 falls within textile category designation 670. Based upon international textile trade agreements products of Vietnam are not currently subject to quota and the requirement of a visa. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
