Dear Mr. Gat: In your letters dated June 26, 2003, and July 28, 2003, you requested a tariff classification ruling. Samples and descriptive literature for item no. SP-205286 Eight Disk Spice Set, comprised of one bottle each of onion flakes, parsley, vegetable mix, chili flakes, coriander seeds, curry mix, oregano flakes, and coriander sesame mix were submitted with your first letter. The bottles are placed in a steel wire rack with a handle. A description of the manufacturing process for the coriander sesame mix and the botanical name for the oregano were provided with your July letter. The tariff classification of all but two of the components of this set were addressed in NY J86635, dated July 22, 2003. The oregano flakes are dried flakes of (Origanum vulgare L.), and the coriander sesame mix is composed of coriander flakes and sesame seeds (not toasted). The applicable subheading for the bottle of oregano flakes (Origanum vulgare L.) in item no. SP-205286 will be 1211.90.9090, HTS, which provides for plants and parts of plants (including seeds and fruits), of a kind used primarily in perfumery, in pharmacy or for insecticidal, fungicidal or similar purposes, fresh or dried, whether or not cut, crushed or powdered, other, other, other, other. The rate of duty will be free. The applicable subheading for the bottle of coriander sesame mix in item no. SP-205286, will be 2103.90.8000, HTS, which provides for mixed condiments and mixed seasonings… other…other. The rate of duty will be 6.4 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
