Dear Ms. Burgess-Young: In your letter dated June 4, 2003, you requested a classification ruling for ladies handbags and a tote bag. You have submitted four samples of ladies handbags and a tote bag with your request. They are as follows: Style CSW-1029, described as “Sophie Drawstring Bag”, is a lady’s shoulder bag manufactured with an exterior surface of 100% cotton denim textile material. The bag features a textile-lined interior with a zippered back wall pocket. The top of the bag is secured by means of a drawstring top closure. Style CSW-1030, described as “Jill Canvas Zip Top Bag”, is a lady’s handbag manufactured with an exterior surface of 100% cotton canvas fabric. The interior of the bag is textile lined with a zippered back wall pocket. The bag features double carrying handles and a top zippered closure. Style CSW-978, described as “Quilted Messenger Bag”, is a lady’s shoulder bag manufactured with an exterior surface of 100% polyester man-made fiber textile material. The interior is textile-lined with a zippered back wall pocket. The top of the bag has a flap closure. Style CSW-984 described as a “Tote all Bag”, is a double handle, open top tote bag measuring approximately 17”(W) x 16”(H) designed to contain personal effects and accessories on a daily basis. It is manufactured with an exterior surface of polyester man-made fiber textile material. The bag features a single, textile lined interior compartment with a zippered wall pocket on one side and double pockets on the other side to contain cell phone, etc. Your samples are being returned as requested. The applicable subheading for styles CSW-1029 and CSW-1030 will be 4202.22.4500, Harmonized Tariff Schedule of the United States (HTS), which provides for handbags, whether or not with shoulder strap, including those without handle, with outer surface of textile materials, of vegetable fibers and not of pile or tufted construction, of cotton. The duty rate will be 6.4 percent ad valorem. The applicable subheading for style CSW-978 will be 4202.22.8050, HTS, which provides for handbags, whether or not with shoulder strap, including those without handle, with outer surface of textile materials, other, of man-made fibers. The duty rate will be 17.8 percent ad valorem. The applicable subheading for style CSW-984 will be 4202.92.3031, HTS, which provides travel, sports and similar bags, with outer surface of textile materials, other, of man-made fibers, other. The duty rate will be 17.8 percent ad valorem. HTS 4202.22.4500 falls within textile category designation 369. HTS 4202.22.8050 and 4202.92.3031 falls within textile category designation 670. Based upon international textile trade agreements products of China are not currently subject to quota and the requirement of a visa. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
