Hoffacker Barthco Trade Consultants 7575 Holstein Avenue Philadelphia, PA 19153 RE: The tariff classification of a woman’s cardigan from the Federated States of Micronesia and a woman’s shirt and hat from Burma/Myanmar Dear Mr. Hoffacker: In your letter dated May 22, 2003, on behalf of Global Gold, Inc., you requested a tariff classification ruling. You submitted three samples. Style 73329 is a woman’s cardigan that is constructed from 100% polyester, fleece knit fabric. The outer surface of the garment measures more than 9 stitches per 2 centimeters in the horizontal direction. The cardigan features a hood, long sleeves with zippered cuffs, a full front opening with a zipper closure, kangaroo pockets in the front at the waist, and a hemmed bottom. Style 73671 is comprised of a woman’s shirt and hat that are constructed from 100% polyester, fleece knit fabric. The outer surface of the shirt measures 10 or more stitches per linear centimeter in both the horizontal and vertical directions. The shirt features a hood, long hemmed sleeves, a full front opening with a zipper closure, and a hemmed bottom. The ski-type hat has a tassel on top. The applicable subheading for the cardigan will be 6110.30.3055, Harmonized Tariff Schedule of the United States (HTS), which provides for sweaters…and similar articles, knitted: of man made fibers: other…other: women’s. The rate of duty will be 32.2% ad valorem. The subheading for the shirt will be 6106.20.2010, which provides for women’s shirts, knitted: of man made fibers: other: women’s. The duty rate will be 32.3% ad valorem. The subheading for the hat will be 6505.90.6090, which provides for hats and other headgear, knitted: of man made fibers: knitted or crocheted or made up from knitted or crocheted fabric: other. The duty rate will be 22 cents/kg + 7.7% ad valorem. The cardigan and the shirt fall within textile category designation 639. The hat falls in category 659. Based upon international textile trade agreements Category 639 from the Federated States of Micronesia and Burma/Myanmar are neither subject to quota nor the requirement of a visa. Category 659 from Burma/Myanmar is neither subject to quota nor visa requirements. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
