NY J84874 June 9, 2003 CLA-2-84:RR:NC:1:103 J84874 CATEGORY: Classification TARIFF NO.: 8479.82.0040 Ms. Virginia Sullavan Canter Samuel Shapiro & Company, Inc. 401 East Pratt St., Suite 500 Baltimore, MD 21202 RE: The tariff classification of industrial mixers from Turkey Dear Ms. Sullavan Canter: In your letter dated May 16, 2003 on behalf of Design Integrated Technology Inc. you requested a tariff classification ruling. Your client intends to import various types of portable and stationery industrial mixers. The mixers will feature an iron chassis and stainless steel mixing components, and will have capacities ranging from 50 to 2000 liters. The mixing machines will incorporate low or high speed motors, depending on the material to be mixed, and will be used in the manufacture of a wide range of products, including cosmetics, inks, pharmaceuticals, foodstuffs, and chemicals. The applicable subheading for the industrial mixers will be 8479.82.0040, Harmonized Tariff Schedule of the United States (HTS), which provides for machines and mechanical appliances having individual functions, not specified or included elsewhere (in chapter 84): other machines and mechanical appliances: mixing, kneading or stirring machines. The rate of duty will be free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
