Powell Company 4477 Woodson Road, Suite 123 St. Louis, MO 63134 RE: The tariff classification of utility pouches from China Dear Ms. Boedicker: In your letter dated May 5th, 2003 you requested a tariff classification ruling. The request is on behalf of EW Enterprises, Inc. The samples submitted, identified as “Cloth Pencil Bags”, measure approximately 10”W x 5 ½”H. Constructed of a woven cotton exterior surface and a poly/cotton inside lining, the pouches feature a zippered enclosure across their tops. The submitted samples will be returned as requested. The applicable subheading for the utility pouches will be 4202.92.1500, Harmonized Tariff Schedule of the United States (HTS), which provides for, in part, for travel, sport and similar bags, with outer surface of textile materials, of cotton, not pile or tufted. The rate of duty will be 6.4 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
