The tariff classification of a conveyor roller from Canada

Krueger Danzas AEI Customs Brokerage Services 29200 Northwestern Highway Southfield, MI 48034 RE: The tariff classification of a conveyor roller from Canada Dear Mr. Krueger: In your letter dated April 3, 2003 on behalf of Canimex Inc. of Drummondville, Quebec, Canada you requested a tariff classification ruling. Your inquiry included a sample of the conveyor roller as well as a schematic drawing on which the roller was identified as item C4-31W-7/8-SOR-VG15. The roller, which resembles a skate wheel, consists of inner and outer races, steel balls, and an internal and external case. It is 49.25 millimeters in diameter, 22 millimeters in width, and features a central hole approximately 6.5 millimeters in diameter. Several rollers can be mounted on shafts placed within a supporting frame, thus forming the surface of a roller conveyor. The rollers spin freely, allowing goods to be moved along the conveyor manually or by means of gravity. We agree with your contention that these conveyor rollers are classifiable as parts of conveyors. Since roller conveyors are classifiable in heading 8428, Harmonized Tariff Schedule of the United States (HTS), the applicable subheading for the roller will be 8431.39.0010, HTS, which provides for parts suitable for use solely or principally with the machinery of heading 8428: other: of elevators and conveyors. The rate of duty will be free. Your suggested classification of subheading 8431.49.9060, HTS, does not provide for parts of conveyors and thus is not applicable. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
