Box 3111 Burbank, CA 91508-3111 RE: The tariff classification of a howitzer projectile from Canada and Bulgaria. Dear Mr. Kessler: In your letter dated March 25, 2003, you requested a tariff classification ruling. You are requesting the tariff classification on two projectiles, 155 millimeter and 175 millimeter in size. The subject projectiles (in the two sizes stated) are howitzer projectiles that are actually high explosive artillery shells used principally for fragmentation and blast effects. The correct classification will be in Chapter 93 as other ammunition and projectiles. You have included detailed illustrations of the merchandise. The applicable subheading for the two howitzer projectiles (155 millimeter and 175 millimeter in size) will be 9306.90.0040, Harmonized Tariff Schedule of the United States (HTS), which provides for other…bombs, grenades, torpedoes, mines and similar munitions of war; other ammunition and projectiles. The rate of duty will be free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
