Dear Mr. Ally: In your letter dated December 20, 2002, you requested a tariff classification ruling. The submitted sample is a set of four decorative coupe-shaped porcelain dessert plates, item number C-77039S, with each measuring approximately 20.95 cm in diameter and possessing a full-sized floral design with the wording “Les Fleurs de Parfums Givenchy” on its rim. These plates are noted to be sold as dessert plates that are microwave and dishwasher safe, and based on the information submitted, they are valued not over $8.50 per dozen. The applicable subheading for this set of porcelain dessert plates will be 6911.10.8010, Harmonized Tariff Schedule of the United States (HTS), which provides for other tableware, kitchenware…of porcelain or china…other, suitable for food or drink contact. The rate of duty will be 21.3 percent ad valorem. You asked whether this product is subject to antidumping duties or countervailing duties.
