Box 1738 Blaine, WA 98231-1738 RE: The tariff classification of picket packages from China and Canada. Dear Mr. Sveum: In your letter dated November 18, 2002, you requested a tariff classification ruling. You have described your samples as picket packages and are further described as follows: Picket package, part #7461 - consisting of 15 aluminum pickets (hollow tubes) which are 37 3/8” in length with an approximate ¾” inner diameter and 32 aluminum level picket spacers. Picket package, part #7465 - consisting of 15 aluminum basket pickets (hollow tubes having a bend along its length) which are 37 3/8” in length with an approximate ¾” inner diameter and 32 aluminum level picket spacers. The pickets are made in China. They are packaged with the spacers which are made in Canada. You have stated that all components are made of pure aluminum and the pickets are seamless. The applicable subheading for the pickets with the spacers, which are packaged together for retail sale and sold as a set, will be 7608.10.0030, Harmonized Tariff Schedule of the United States (HTS), which provides for aluminum tubes and pipes: of aluminum, not alloyed: seamless. The rate of duty will be 5.7% ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
